Decree: Definition and Types

Section 2(2) of the CPC defines a decree as a formal expression of adjudication by the Court determining the rights of the parties with regard to any matter in controversy. Decrees may be preliminary, final, or partly preliminary and partly final.

Essential Elements of a Decree

  • Formal Expression: Decision must be expressed formally for legal recognition and appeals.
  • Adjudication: Court must determine the matter in dispute judicially.
  • Suit: Must arise from a civil suit or statutorily treated suit.
  • Rights of the Parties: Concerns substantive/procedural rights of plaintiffs and defendants.
  • Conclusive Determination: Final and complete decision; not an interlocutory or interim order.

Types of Decrees

  • Preliminary Decree: Decides certain rights but leaves the case partially open.
  • Final Decree: Disposes of the suite entirely; settles all issues.
  • Partly Preliminary/Partly Final: Some disputes are resolved, others await final decision.

Adjudication and Suits

Adjudication must arise from a civil suit; applications under specific acts (e.g., Hindu Marriage Act, Succession Act) can be statutory suits with decisions treated as decrees.

Rights of Parties and Conclusive Determination

Only parties to the suit (plaintiff and defendant) have their rights determined by decree; decisions affecting third parties or dismissing costs applications are not decrees. Only conclusive orders, not interim/interlocutory directions, qualify.

Amendments to Decree

Clerical or accidental errors in decrees can be remedied under Section 152 CPC by court order, but not errors that would cause significant negligence or prejudice.
